<h1>§ 15 BAföG</h1>
<p><strong>(1)</strong> Training will be provided from <a href=the beginning of the month in which the training commences, but at the earliest from the beginning of the month of application.

(2) Training support is provided for the duration of the apprenticeship – including the free time of lessons and lectures. However, for courses of study at colleges and academies within the meaning of § 2 (1) sentence 1 point 6, this is only up to the end of the maximum funding period pursuant to § 15a In distance education institutions, training support is provided for a maximum of 12 calendar months.

(2a) Training is also provided as long as the trainees are prevented from completing the training due to illness or pregnancy, but not beyond the end of the third calendar month.

(3) In addition to the maximum funding period, training support will be provided for a reasonable amount of time if they

  1. for serious reasons,
  2. as a result of caring for a close relative in the sense of § 7 (3) of the Pflegezeitgesetz, who is classified according to §§ 14 and 15 of the Eleventh Book of Social Insurance – Social Care Insurance – at least in Grade 3,
  3. as a result of involvement in statutory and statutory committees and bodies

a) colleges and academies within the meaning of § 2 (1) sentence 1 point 6,

b) self-administration of students at educational institutions as defined in letter a,

c) the Studentenwerke and

d) of the countries,

  • as a result of first failing the final exam,
  • as a result of disability, pregnancy or the care and upbringing of a child up to 14 years
  • has been exceeded.

    (3a) Apprentices at colleges and academies within the meaning of § 2 (1) sentence 1 number 6, who are in a self-contained study program, will receive assistance for graduation for a maximum of twelve months of training support also after the end of the maximum funding period or the funding period referred to in paragraph 3 Number 1, 3 or 5, if the trainees have been admitted to the final examination no later than four semesters after that date and the Examining Board certifies that they can complete the training within the duration of the graduation assistance. If a final examination is not provided, sentence 1 shall apply provided that the trainees present a confirmation from the training center that they can complete the training within the duration of the aid to complete the degree.

    Administrative provision to § 15 BAföG

    to paragraph 1

    15.1.1 Training will be provided from the beginning of the month in which the training is started, provided that a written request has been submitted by that month at the latest.

    to paragraph 2

    15.2.1 Training support is not provided as long as the apprentice does not attend the training center for a reason for which he is responsible or does not participate in the internship.

    15.2.2 Educational support is paid in full for the month in which the relevant training period ends.

    15.2.3 During the non-teaching period, training support can only be provided if this in a year does not exceed 77 holiday days. This does not apply to the lecture-free time in higher education.

    If the non-teaching time exceeds 77 holiday days in one year, the duration of the grant will be reduced by one calendar month for each commenced period of 26 holiday days.

    15.2.4 In calendar months for which the trainee is on leave, training support is not provided. See also item 9.2.2 sentence 2.

    15.2.5 Training is generally provided for the duration of the training. When attending courses of study at higher education institutions or these according to § 2 Abs. 3 as equivalent designated training centers promotion beyond the maximum funding period but only if the conditions of § 15 paragraph 3 or § 15 paragraph 3 a is present.

    15.2 a.1 The month in which the beginning of the training-hindering event falls is not included in the three-month deadline.

    15.3.1 A time is appropriate if it corresponds to the loss of time due to the reason justifying the exceeding of the eligibility period.

    Adequate is always the time of exceeding, which is prescribed by a competent authority, eg. For example, the requirement of a board of examiners to repeat a fixed number of study semesters after the final exam has failed.

    15.3.2 In addition to the maximum funding period, training support is not provided if the trainee does not complete the training within the period of eligibility extended in accordance with Paragraph 3 or if he meets the requirements for admission to the statutory audit (see also § 15.3 a.4 a and 15.3 a.5).

    15.3.3 Serious reasons that can justify support beyond the maximum funding period are in particular

    • a disease,
    • an interruption of training for the performance of basic military or civil service, these equivalent services (eg, under § 13 b military service law, § § 14 a, 14 b civil service law of the “development service” and “other services abroad”), a voluntary social or ecological year,
    • a prolongation of the exam time not to be represented by the trainee (eg in case of sudden illness of the examiner),
    • late admission to courses required for examinations (eg “internal numerus clausus”),
    • the first failure of an intermediate examination if it is a prerequisite for the continuation of the training; The same applies to the first-time repetition of a study semester due to the failure of proof of performance, if proof of performance is to be provided on an ongoing basis instead of an intermediate examination.

    These serious causes must be the cause of the delay in training. The delay must not be avoided in a reasonable manner for the trainee.

    In cases of doubt, the responsible health authority can be heard by mutual assistance about the illness.

    15.3.6 A final exam is not passed if the trainee has completed all the examinations which he had to perform under the relevant examination regulations, but overall without success. Failure to pass the final examination within the meaning of subsection (3) no. 4 shall also be deemed to have occurred if the examination is deemed failed because of the failure in an examination part without the candidate performing all the examinations. On the other hand, the period of eligibility will not be extended if the final examination is deemed to have failed for other reasons (eg deception, absence from the examination).

    Paragraph 15 (3) (4) shall apply mutatis mutandis if the test is partially passed and the trainee is admitted to a follow-up or repeat test with regard to the remaining parts.

    15.3.7 Funding according to paragraph 3 point 4 is only possible if the final examination has been successfully completed within the maximum funding period pursuant to § 15a or within the extended funding period according to numbers 1, 3 and 5. In the case of failure of the exam because of failure in a part of the examination, the performance of training support requires that the trainee could have claimed training support until the last part of the first test.

    15.3.8 The disability must be the cause of the delay in training. In case of doubt, the responsible pension office can be heard by mutual assistance.

    When ascertaining a disability, certificates issued by other competent authorities (eg according to §§ 3 and 4 of the Severely Handicapped Persons Act) are generally to be assumed. The Office for the Promotion of Formation should separately examine whether the disability is the cause of the delay in training.

    15.3.9 As children, the persons mentioned in Item 25.5.1 must be considered.

    15/3/10 The pregnancy or the care or upbringing of a child up to ten years must be the cause of the delay of the training. Within the framework of § 15 (3) no. 5, the following times are always appropriate:

    • Pregnancy: 1 semester,
    • until the age of 5: 1 semester per year,
    • for the 6th and 7th year of the child: a total of 1 semester,
    • for the 8th to 10th year of the child: a total of 1 semester.

    The benefit of § 15 (3) no. 5 may not exceed one semester for the respective periods, even if several children are cared for at the same time. It can be distributed to both studying parents. In this case, parents have to give a statement about how childcare was shared between them.

    to paragraph 3a

    15.3 a.1 Help for graduation according to § 15 Abs. 3 a can only be provided for students at universities who are in a self-contained study program. For students in self-employment additional training (eg according to § 7 Abs. 2 Nr. 2) § 15 Abs. 3 a does not apply.

    15.3 a.2 § 15 para. 3 a regulates the help for the final degree. It is also to be paid if no funding has been requested beforehand. The provisions of § 15 (3) and § 48 must not be applied during the duration of the application.

    15.3 a.3 Prerequisite for the help to graduate is

    • Admission to the final examination within the maximum funding period or within four semesters after the end of the maximum funding period or the admission to the final examination within the extended funding period according to § 15 (3) Nos. 1, 3 or 5 or within four semesters after the end of this funding period and
    • the submission of a certificate from the training center or the examination center confirming that the trainee can complete his training within twelve months at the latest.

    The funding is usually granted for twelve months: there is no need to differentiate according to the examination duration possible for the individual study program (eg if it is shorter than twelve months) according to the study and examination regulations.

    If the Office has indications that the apprentice will complete the training before the end of a period of twelve months, a shorter period of approval must be set up.

    15.3 a.4 The certificate must be issued by a full-time member of the faculty or the head of the examination office.

    15.3 a.4 a If, in the case of the so-called “sliding examination procedure”, admission to the final examination is already completed after the intermediate examination, the certificate of the examination office must contain a statement as to whether all essential study achievements have actually already been completed; this finding must be justified. The Office for the Promotion of Education must also examine the certificate with particular care from this point of view.

    15.3 a.5 In degree programs without admission procedures, the admission to the final examination within the meaning of § 15 (3) a a. For example, the issue of the diploma / master’s thesis or the announcement of the examination dates.
