1. Scope
1.1 These Terms and Conditions (hereafter “Conditions“) Apply to the between you and us, the Stiftung Württembergische Philharmonie (hereinafter”WPRContracts for the purchase of tickets, vouchers, goods, electoral subscriptions or the conclusion of a subscription contract.

1.2 Furthermore, the GTC also apply via the online shop on the website www.wuerttembergische-philharmonie.de (hereinafter “Online shop“Contracts” with regard to the purchase of tickets, vouchers and goods.

1.3 Furthermore, the GTC apply to the access to events of the WPR and represent the rules for the visitors.

1.4 Subscribers are also subject to the subscription terms.

2. Purchase of tickets and subscriptions

2.1 General regulations
2.1.1 Schedules and start times
The current beginning concert programs will be announced by the WPR in the official publications it publishes and on its website. Changes, even short-term, remain reserved. For occupation information no guarantee is taken over. For information in other publications, WPR assumes no responsibility.

2.1.2 Entrance fees and reductions
The valid admission prices and discount conditions are on our homepage under cards & Service: Prices seen. Changes are expressly reserved. For individual events (such as special events) a special pricing is possible. Entrance fees and reductions are only valid for own events of the WPR, not for guest performances.

Discounted cards are only valid in conjunction with the respective proof of eligibility and are non-transferable. On already acquired tickets, no discount can be granted later. The discount does not apply to vouchers or fees.

Wheelchair users and one accompanying person each have a certain number of special places available, which must be ordered separately from the WPR ticket office.


According to the printed map, the ticket entitles the holder to use all means of transport of the Neckar-Alb-Donau (naldo) transport network within four hours before the start of the event for the journey to the venue and at the end of the event. With regard to the use of the ticket as a ticket, there is a separate contractual relationship between the customer and naldo for which the conditions of carriage of the naldo be valid.

2.2 Reservation and pre-sale
2.2.1. Regulations for all sales channels
Advance ticket sales begin at the WPR ticket office, ticket outlets and online at the times specified in the WPR publications. WPR reserves the right to restrict the sale in terms of time, with regard to the issue of reduced tickets and / or with respect to certain distribution channels. Special arrangements may apply to group orders.

2.2.2 Exchange and return of tickets
An exchange or redemption of tickets for reimbursement of the purchase price is not possible. For expired cards no replacement is made. The regulations of the BGB concerning distance selling contracts do not apply according to § 312 b III number 6 BGB.

Changes to the cast and other short-term changes to the performance of the performance or cases of force majeure (traffic obstruction, illness, strike, weather, etc.) do not entitle the holder to return tickets. In case of cancellation or cancellation of a performance, if less than half of the performance was played at the time of cancellation, a replacement performance will be offered or, if this is not possible due to technical reasons or other reasons, the entrance fee will be reimbursed. Any further claims are excluded in these cases; In particular, expenses of the visitor such as travel or accommodation costs etc. can not be replaced. The claim for reimbursement of the ticket price expires if it is not asserted against the WPR within ten days.

Tickets can be booked in person or by telephone at the ticket office of the WPR and at the ticket agencies and must be picked up within 7 days, after 7 days the reservation will be automatically deleted by the system. From 7 days before the event a reservation for the box office is possible. Tickets reserved for the box office must be picked up no later than 30 minutes before the start of the performance, after which time the reservation will be forfeited.

The box office opens one hour before the beginning of the event, at symphony concerts because of the introduction already at 18.45 clock and closes in principle at the beginning of the performance. Advance sales and reservations for other events are not possible at the box office. Only cash payment is possible.

2.2.5 Card Office of WPR
The ticket office of WPR is open Monday to Friday from 08: 00-12: 30. Payment for tickets, vouchers and items at WPR’s ticket office is in cash, by ec card, by SEPA direct debit or by a voucher issued by the WPR. Telephone orders can be deposited at the box office or sent for 3 euros shipping fee at the risk of the customer by mail, the payment is made exclusively by SEPA direct debit. Matinee and Soul Balm Concert tickets are available only at the WPR ticket office.

2.3 Ticket sales in the online shop

Online orders are possible with the start of pre-sale via the game plan or the shop of the WPR. Tickets for matinee and soul balm concerts are not available online.

You can select the desired concert under the tab “Concerts” and click on the link “Buy tickets”. This link can be found in the concert overview below the appointment or at the end of the concert description, provided that the concert is approved for online ticket sales. If you click on the link you will see a presentation of the places in the concert hall, which will allow you to choose between the places still available within the displayed price groups. By clicking on the desired places individually they are marked. Via the corresponding button on the right side you can either cancel the marking or put the cards for the corresponding seats into the shopping cart. In the shopping cart you also have the opportunity to choose a possible discount category. The products in the shopping cart can be viewed at any time by clicking on the button “go to cart” in the upper right corner of the shop. If you want to buy the cards in the shopping cart, you must first register as a customer by entering your e-mail address, a password and your address data or register as an already registered customer by specifying your customer number / e-mail address and your password. The mandatory information is marked with a *. Your data is encrypted. Then you have to select the desired payment method. By clicking on the “buy now” button, you submit a binding offer to buy the cards in your shopping cart. However, your offer can only be made if you agree to our terms and conditions by ticking the boxes, as well as to notice the cancellation policy, which can be viewed by a link. The ordering process can be canceled at any time by closing the browser window. The order confirmation will be sent to you by e-mail immediately after sending the order. That seals the buying contract.

2.3.1 The user is obliged to provide truthful information when ordering. If the user omits this information or if he gives false data in the first place, in particular an incorrect e-mail address, WPR may, if a contract has been concluded, withdraw from the contract.

2.3.2 Online orders can be deposited at the box office or sent by mail at the risk of the customer for a fee of € 3.00. The delivery time is 2 to 4 working days after receipt of the order. Any delays in delivery will be communicated to the customer as soon as possible. When picking up at the box office, the user will receive a confirmation of purchase with a pick-up number for printing and presentation at the box office.

2.3.3 Payment for online orders is made exclusively by SEPA direct debit. The cost of returned direct debits will be charged to the buyer.


2.3.4 The WPR reserves the right to change, supplement or delete the presentation or space offered for online sales at any time and without any special notice, or to discontinue the online sale temporarily or completely.

3. Purchase of goods from the online store

3.1.1 You have the option of selecting and ordering products on our shop pages. The presentation of the products in the shop does not constitute a legally binding offer, but an invitation to order. Once you have found the product you are looking for, you can submit it without obligation by entering the desired order quantity and clicking on the corresponding button in the shopping cart. The products in the shopping cart can be viewed at any time by clicking on the “shopping cart” button in the top right corner of the shop and then removed either by clicking on the “empty cart” button or by removing the tick in the OK column in front of the product and clicking on ” refresh “button. 3.2 The shipping costs for the delivery of your order within the EU amount to a flat rate of 3.00 Euro. There is no minimum order value.

3.3 Payment for online orders is made exclusively by SEPA direct debit. The cost of returned direct debits will be charged to the buyer.

3.4 Unless otherwise agreed, delivery within the EU will be made to the billing address specified by you from the warehouse. The delivery time is 2 to 4 working days after receipt of the order. Any delays in delivery will be communicated to the customer as soon as possible. We are entitled to partial deliveries, as far as this is reasonable. Additional shipping costs arise only with explicit agreement.

3.5 For the products offered in our shop, the legal warranty rights exist.

4. Right of withdrawal for purchases in the online shop

An exchange or redemption of tickets for reimbursement of the purchase price is not possible. For expired cards no replacement is made. The regulations of the BGB concerning distance selling contracts do not apply according to § 312 b III number 6 BGB.

CDs can only be returned unopened or sealed. With opened / uneingeschweißten CDs there is no right of withdrawal. By opening the packaging of CDs, the buyer accepts copyright protection. Exchange of CDs with opened or damaged original packaging is excluded. Something else is only valid if the data carrier is defective or illegible.

4.3 Other goods

Cancellation

You can cancel your contract within two weeks without giving reasons in writing (for example, letter, fax, e-mail to [email protected]) or by returning the goods. The period begins at the earliest with receipt of the goods and a detailed instruction in writing. To meet the deadline, the timely dispatch of the revocation or the goods is sufficient. You can use the attached model withdrawal form, which is not required.

Consequences of the cancellation:

If you withdraw from this Agreement, we shall reimburse you for any payments we have received from you, including delivery charges, promptly and no later than fourteen days from the date on which we receive the notice of cancellation of this Agreement. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; in no case will charges be charged for this repayment. We may refuse to repay you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the immediate costs of returning the goods.

You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functioning of the goods.

The Württembergische Philharmonie Reutlingen Foundation will remain the owner of the purchased item until all claims arising from the delivery, including ancillary claims, have been met.

5. Subscription Conditions Fixed Subscriptions

5.1 Scope of the subscription
The subscription is valid for one season and includes per subscriber a designated place for all concerts in a concert series. The playing time depends on the current one Schedule. The duration of the current season and the exact number of concerts included in the respective subscription are available on our homepage cards & Service: subscriptions can be obtained or requested by phone from the card office of the WPR. A change of location is not possible during the season. Change requests can be communicated to the WPR at any time, these are taken into account in the order in which they are received.

5.2 Subscription price and reductions

The respective valid subscription prices and discount conditions are on our homepage under cards & Service: Prices apparent.

5.3 Payment method
Payment for the subscription will be made in cash, by ec card, bank transfer, SEPA direct debit or by voucher issued by WPR.

5.4 Sending / picking up the subscription passes
The collection of subscription tickets for the upcoming season is possible at the WPR ticket office from the beginning of July, and the exact date can be found in WPR’s publications. The shipping of the subscription passes takes place in the first week of September for a shipping fee of 3 euros at the subscriber’s risk.

5.5 Exchange and redemption
There is no right to take back and exchange subscription cards.

Changes to the program as well as reshuffling are reserved and do not entitle to the withdrawal or exchange of subscription cards. The WPR reserves the right to implement it if necessary for organizational or artistic reasons. Unvisited concerts can not be refunded.

5.6 Renewal of the subscription
The subscription will continue to be valid for the next season if it is not canceled in writing by 30 June of the current season at the latest. WPR reserves the right to terminate the subscription without notice in case of a breach of subscription terms by the subscriber. This also applies in the event that a subscriber repeatedly disturbs the performance of the concert events or otherwise impaired. In this case, the subscriber must immediately return the subscription card to the WPR. After the return, the subscription amount will be reimbursed pro rata.

5.7 Disclosure of subscription cards
The public and commercial resale of subscription cards is not permitted. In the private sphere subscription cards can be passed on, a right to issue a replacement card does not exist.

5.8 Change of name, address, bank details
The subscriber is obliged to notify the card office in writing of changes to the name, address and payment by means of a SEPA direct debit.

5.9 Loss of subscription passes
If a subscriber loses his or her subscription card, he / she may be issued with a replacement card upon presentation of the identity card and a fee of five euros. In this case, the original passport loses its validity.

6. Subscription Conditions Election Subscriptions

6.1 Scope of the election / mixed subscription
The subscription is valid for one season and includes per subscriber:

Elective concert symphony concert: 4 vouchers for a symphony concert

Electoral Kaleidoscope: 4 vouchers for a kaleidoscope concert

Mischabo: 2 vouchers each for a symphony and a kaleidoscope concert

6.2 Subscription price and reductions

6.3 Payment method
Payment of the voting / mixed subscription is made in cash, by ec card, by bank transfer, by SEPA direct debit or by means of a voucher issued by the WPR.

6.4 Sending / picking up the vouchers or tickets
The booking of electoral subscriptions and the collection of vouchers for the upcoming season is possible at the GEA concert office in the market or at the WPR ticket office from the beginning of July, the exact date can be found in WPR’s publications. The vouchers or tickets will be sent after redemption has taken place directly after the order has been placed / redeemed. Each shipment will be charged a shipping fee of 3 euros, the shipping risk is borne by the subscriber.

6.5 Redemption of the vouchers

The redemption of the vouchers in tickets for the upcoming season is possible in the GEA concert office on the market or the ticket office of the WPR from the beginning of September, the exact date is on the homepage of the WPR under cards & Service: Single tickets seen. The redemption of vouchers in tickets takes place as far as available in the booked price group, otherwise in a lower or against payment in a higher price group. A claim for free places does not exist.

6.6 Exchange of tickets after redemption

If a booked appointment can not be made, it is possible to switch to another concert of the same series within the current season, if still available. The exchange must be made at the latest one day before the concert on presentation of the ticket in the GEA concert office on the market or at the card office of the WPR. Unvisited concerts can not be refunded.

8. Visitor Regulations for the venue “Studio of the WPR” (Marie-Curie-Str 8, 72760 Reutlingen)
8.1 Entry into the auditorium is granted only with a valid ticket.

8.2 Visitors who arrive after the start of the performance are not entitled to enter the auditorium before the break. They can take their seats only for a break. Likewise, if the sign for recapturing the seats after the break has not been respected, no claim to admission may be made after the performance has restarted. For non-break events, there is no entitlement to admission to the auditorium when visitors arrive after the performance has begun. The instructions of the inlet staff with regard to the time of admission as well as the next available space must be followed. For events in the studio of the WPR with free choice of seats is not entitled to a specific seat.

8.3 The WPR is not liable for lost or damaged items, nor for the loss of items in the premises of the WPR. The loss of property must be reported to the entry or supervisory staff immediately. Objects of any kind found in rooms of the WPR are to be handed over to the admission or supervisory staff. The items will be stored by the WPR for a period of six months. For the rest, §§ 978 ff. BGB apply.

8.4 Smoking is prohibited in the premises of WPR.

8.5 The entrainment of food and drinks in the auditorium and the local consumption are prohibited.

8.6 Photographing, filming and sound recording during the performance or other events of the WPR are strictly forbidden for copyright reasons, unless there is a special written approval from the management.
Illegally recorded image or sound material is to be deleted by the owner in the presence of a representative of the management. If necessary, the visitor can be excluded from attending the performance.

8.7 Mobile devices and other devices of any kind that emit acoustic or optical signals may only be taken in the auditorium when switched off.

8.8 Children under the age of 3 are not permitted to attend regular WPR events unless they are events or tours suitable for or designed for children of that age. Age recommendations for children / adolescents can be obtained from the sales staff.

8.9 The bringing of animals into the premises of the WPR and the auditorium is not permitted.

8.10 The WPR exercises the house right in its venue. It is entitled to pronounce house references or prohibitions in the context of their house right. The instructions of the staff are to be followed without restriction.

8.11 Visitors may be denied access despite a valid ticket if there are reasonable grounds to believe that they disturb the event or harass other visitors. Access can be further prevented if the visitor has violated the terms and conditions. Persons who obstruct the ticket sales, disturb or harass the public, can be evicted from the house. Visitors may be removed from the current event if they disturb them, harass other people or have taken a seat for which they can not show a valid ticket. The instructions of the staff must be followed.

8.12 In case of fire or other dangerous situations, the visitors have to leave the house immediately without detours through the designated exits and emergency exits. The instructions of WPR staff must be followed.

9th house rules foreign venues of the WPR and Stadthalle Reutlingen

9.1 In the case of foreign venues of the WPR and in its main venue, Stadthalle Reutlingen (SHR GmbH), the house or visitor regulations of the respective venue apply, provided that the WPR is the organizer.

9.2 At events of the WPR in the SHR GmbH, the partial or complete evacuation, closure of rooms, buildings and open spaces and their evacuation may be ordered by the authorities, the SHR GmbH or the WPR (organizer) in case of incidents or safety reasons. All persons staying in the venue and on the grounds and open spaces shall promptly and without exception comply with the requests of the authorities, SHR GmbH, the WPR and the designated security service, the police and the fire brigade, and the assembly site in an evacuation order leave immediately without picking up the wardrobe beforehand.

10. Liability

For damages, the WPR is liable, for whatever reason, only,

a) WSP or its legal representatives or vicarious agents are guilty of intent or gross negligence

b) culpable injury to life, body, health

c) culpable violation of essential contractual obligations

d) in the case of defects which the WPR fraudulently concealed or whose absence the WPR has guaranteed

e) as far as according to the Product Liability Act for personal injury or material damage to privately used objects is liable.

WPR is not liable for any further claims for damages.

An essential contractual obligation is a duty, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner regularly trusts and may trust.

In case of slightly negligent breach of essential contractual obligations (excluding intent and gross negligence) WPR is only partially liable for the contractually typical, reasonably foreseeable damage.

The contract-typical, foreseeable damage is to be recognized in the amount of the contract value of the service concerned.

11. Dispute resolution procedures
The European Commission is providing a platform for out-of-court online dispute resolution (OS platform), which will be published under www.ec.europa.eu/consumers/odr is callable. Our e-mail address can be found in our imprint. We are neither committed nor willing to participate in the dispute resolution process.

12. Applicable law
Subject to compulsory consumer protection regulations, this contract is exclusively subject to the law of the Federal Republic of Germany. The application of the UN Sales Convention (CISG) as well as of international private law is excluded.

13. Final provisions

Should individual provisions be or become ineffective, the remaining conditions shall remain unaffected. In place of the invalid provision, the relevant statutory provisions apply.
