Bafög and pupil-bafög own apartment

BAföG means pronounced federal education promotion law and regulates the state support of pupils and students. An application is definitely worth trying. A basic distinction is made between student BAföG for students and normal BAföG (here also master BAföG) for students. The maximum requirement rate has been € 670 since October 1, 2010.
First of all, it should be said that the law sees no real separation between the student BAföG and the student BAföG. Finally, the BAföG’s requirements and provisions only depend on the type of school.

If you are actually entitled to BAföG, you are not allowed to receive any benefits other than child benefit, e.g. Receive housing benefit.

Approval and amount of BAföG requirements are therefore based on:

  • Type of education / degree
  • Place of training (place does not matter when studying)
  • Own apartment or living with parents
  • Maintainability of the parents, their and your own income
  • Existing health and nursing care insurance
  • Own children

Factors for determining needs

basic needs Depending on the training institution, there is a legally required basic requirement.
residential package If you have your own household as a student and have schooling with the requirement of completing your professional qualification, the flat rate is € 224.
KV supplement You are only entitled to the supplement to health insurance and long-term care insurance if you can prove that you yourself are liable to pay contributions. Co-insurance with parents precludes this.
PV surcharge

The student BAföG

Requirements that lead to funding:

  • And Way to school too far from home
  • Or own household and own children
  • Or you’re married or divorced
  • A school education sets a completed vocational training
advance, generally no reason has to be given for your own apartment
    to receive student BAföG.

The way to the parents’ house plays an important role in the student BAföG:

The distance between the parents’ home and the training center is considered too far if there is a journey time of 3 hours a day for a return trip of at least 2 hours. Waiting times for means of transport as well as footpath can be added, whereby 15 minutes can be taken for each started kilometer. If not, your application will be processed
possibly be rejected.

What needs to be paid back?

Pupil BAföG is usually as full grant approved so that you can get the money from the state. Academies and higher technical schools are an exception. Half of the student BAföG is available here as a grant and half as an interest-free loan.

When will I be paid student BAföG??

It is normally granted until the end of the training. Learning progress only needs to be shown at academies and higher technical schools.

The Student BAföG

Requirements:

  • Enrollment at any university or college
  • Given a maintenance obligation, the parents’ income is too low
  • You are under 30 (for a master’s course up to 35)
  • Nationality: German
  • No second training (there are exceptions here too)
  • Here, the distance to the parents’ house is irrelevant, since half of the training is financed yourself. This means that the permit mainly depends on the income situation of your parents, as long as parents are not supported independently.

When do performances have to be proven??

As a rule, the BAföG office would like a corresponding one every 4 semesters
Have proof that you are still studying. If this is not possible for any reason, the BAföG will be deleted.

When will I be paid BAföG??

For students, it depends on the duration of the standard period of study. Then you can use the final degree aid or, for example, the one explained on page 78
Education credits are promoted.

What needs to be paid back?

As already mentioned, those need to receive the student BAföG, Nothing repay. Students, on the other hand, only receive a 50% grant, the rest must be paid back without interest after 5 years from the last BAföG rate.

When is the BAföG independent of parents? (without maintenance)

  • Start of training after the age of 30
  • In the case of training on the second educational path (e.g. catching up on the Abitur)
  • Evening high school or colleague (general university entrance qualification on the
    second path of education)
  • A minimum of 5 years of employment before the start of the apprenticeship from the age of 18
  • With orphans

Internships are also funded at BAföG if they are an integral part of a specific training. At Schüler-BAföG they are treated equally.

If you live with your own children under the age of 10 and look after them, it is possible to receive a childcare allowance in addition to the (student) BAföG, which is a flat rate of € 113 per month for the first child and € 85 for each additional child.

Important: Only your own assets play a role here, that the parent or partner is irrelevant.

Eligible assets:

  • cash assets
  • Savings assets and building loan contracts
  • Securities assets

Household items

They do not count as assets if they are needed to set up and run a household. Before you apply and start your apartment, you basically have no items to be credited. If you have too much wealth, you can spend it on the facility beforehand.

debts

Loans that have not yet been paid off or other obligations also reduce assets in the sense of the BAföG.

The car

Cars have recently been counted towards the monthly BAföG without deduction of allowances. It is advisable to register your own car only after the intended BAföG reference to yourself. Depending on the family situation, it should not be a problem to run the vehicle over your father or mother first. If this is not possible for various reasons, you should get one Assessment have the vehicle value of your car created. This is available from DEKRA or ADAC for around € 60.

In special hardships, your car can also be used as a urgent need be classified if the infrastructure offers no other way to get to the educational institution.

Table: allowances on assets

For you as an applicant € 5,200
For your spouse € 1,800
For every child entitled to child benefit € 1,800

The calculation of BAföG assets

The assets at the time of the application
less Debt at the time of the application
less Free allowance (€ 5,200)
= remaining assets as annual value
This results in 12 (12 months approval) monthly assets to be taken into account, which is added to the need.

The calculation of the BAföG for be > Social allowance (21.3%), taxes actually paid (wage tax, church tax, solos)

    Exemption I Single parent € 1,070
    Exemption I Stepparent € 535
Exemption IIChildren and other dependents who are not in eligible training ever …However, only if the siblings really burden the parents’ income financially. + € 485
Additional allowance IIIAfter deducting all taxes and allowances, another 50% as a contribution per parent, plus 5% per child, for which the basic allowance of € 485 applies

    b) Your own income

What not! To the income in the sense of the BAföG counts:

    • Maintenance payments and child benefit
    • ALG II, social welfare, parental allowance and housing benefit
    • Student loans from a bank

What counts as income according to the BAföG:

    • Orphan’s pension for schoolchildren who have completed vocational training (€ 170 free), for all other pupils and students (€ 125 free)
    • Are grants / training grants partially or wholly canceled
      public funds, they are exempt
      count
    • If these are performance and talent-related, € 300 remain free of charge, e.g. Begabtenförderungswerke

Attention: The annual allowance of € 4,800 does not apply to the duration of a mandatory internship during the course (remuneration)

    Other allowances:

    • Exemption for your spouse -> € 535 (if available)
    • Free allowance for each child -> € 485 (if available)
    • Monthly allowance for a part-time job for all trainees in the amount of € 255

As usual, the advertising costs and social allowance are deducted from your annual income in the form of a part-time job. When specifying your gross annual income, the period applies to which the permit applies. The remaining amount is divided by the number of months in the approval period (1/12). From this amount, there is basically another € 255 free, plus additional, above-mentioned allowances, depending on the situation.

Ultimately, this means that you have up to 5.€ 400 or monthly € 450 remains unpaid. Trainees can therefore pursue a € 400 mini job without monthly deductions from the BAföG funding. Up to this amount, the income from marginal employment is also for any existing, non-contributory co-insurance in statutory health insurance (Family insurance) possible without problems.

The calculation of the funding amount according to BAföG

    (individual positions only if applicable)

Basic requirements (by type of training)
plus Flat rate (in your own apartment, depending on the type of training)
plus Increase amount through health insurance
plus Increase amount through long-term care insurance
    plus Childcare allowance
    = requirements record
    less Credit amount own assets
    less Credit amount own income
less Credit amount from the spouse
less Credit amount for parental income
Or if divorced: ½ of the mother’s countable income ½ of the father’s countable income
    = promotion amount

Case study for the BAföG calculation

Marcus (19) is a prospective student and will move into his own apartment near the university next month. His assets at the time of application were € 4,000 through a savings book. The little sister Nina (15) attends the 9th grade of a high school. The parents are married and live together. The father had a gross annual income of € 34,500 last year, the mother € 14,500.
