General

The organizer publishes competitions on Facebook at irregular intervals. Participation in our sweepstakes on our Facebook page is only possible by including these terms and conditions. By participating in the competition, the participant expressly acknowledges these terms and conditions. The competitions are not supported by Facebook and are not affiliated with Facebook. Accordingly, Facebook is not available as a contact person for the respective raffle. The organizer reserves the right to cancel or terminate the competition at any time.

Participation requirements

To participate, a Facebook user account is required. All natural and business persons can participate. These agree to the participation, that all rights to delivered content are transferred to the organizer and in case of profit their name will be published on our Facebook page. Participation does not depend on the purchase of a good or service of the organizer. The purchase of a good or the use of a service does not increase the chances of winning. Participation is only possible within the deadline specified in the respective competition description. Facebook users over the age of 18 are eligible to participate. Employees of the organizer are excluded from participation. The legal process is excluded.

profit

The prize is awarded as described in the competition. If there are several winners, the lot decides to the exclusion of legal recourse. A change or cash payment of the price is excluded. Any costs incurred in the course of arrival and departure, etc., are to be borne by the winner himself. If the winner does not respond to the prize notification within two days, the prize will be forfeited without replacement. Unless stated otherwise in the competition game, the prize can be redeemed on a desired date from Monday to Friday.

liability

Claims for damages against the organizer, which are in connection with the competition, are – within the legally permissible – excluded, regardless of the legal grounds, unless the organizer would have intentionally or grossly negligent violated statutory obligations. Furthermore, the organizer is not liable for damages resulting from the impairment of the availability of the raffle website in the event of non-controllable technical faults and events of force majeure, as well as attacks by third parties against the raffle. However, the organizer will do everything to ensure the reliability and functionality of the competition website. Furthermore, the organizer does not guarantee that the competition page on the respective participant’s computer is properly functional. The participant releases Facebook from any liability.

privacy

The processing of personal data of data subjects shall be in accordance with the applicable European and national legislation. The organizer will not forward any personal data to third parties or sell address data. The organizer stores the personal data of the respective participant exclusively for the purpose of the competition. The participants agree that their details on the participation and execution of the competition are processed and that in case of profit their name will be published on the Facebook page of the Malente holiday service. Use for purposes other than those specified in the conditions of participation does not take place. These consents can be withdrawn at any time with effect for the future, by the participant sends an e-mail to [email protected].

Severability clause

Should individual provisions of these conditions of participation be ineffective or there is a loophole, this shall not affect the validity of the remaining provisions. The ineffective or missing provisions are replaced by a provision which comes closest to the purpose of the contract and the statutory provisions.

Jurisdiction / applicable law

For disputes, German law applies exclusively. The place of jurisdiction is Stendal.
