When Maria later dies, only her children inherit and, if she has married again, her husband inherits the inheritance from the marriage to Peter. Peter’s child from his first marriage then no longer inherits.
The gift: inheritance "with a warm hand"
A condominium for the son, a practice for the daughter, a large amount of money for the birth of the grandchild: there are numerous cases in which the parents’ generation passes on part of their property before death. Experts speak of "Inherit with a warm hand", in contrast to "cold hand" after death.
As with the inheritance, taxes are due on gifts of values above a certain exemption. This is 400,000 euros for children and 200,000 euros for grandchildren.
The mediation should therefore not only be activated in the event of an inheritance, but before that: It can help to prepare and regulate the inheritance during one’s lifetime.
Mediation is widespread in the Anglo-American region, in Germany it is reserved. According to mediator associations, it leads to success in over 70 percent of all cases. In contrast to the process, mediation saves time and money. Also considered they don’t primarily the legal, but the psychological side of the dispute.
