Liability insurance: co-insure children

Despite all care, even adults are not immune to causing costly damage through inattentiveness or negligence – and certainly not children! When playing ball, skateboarding or cycling in the courtyard, the neighbour’s patio door can break quickly or a friend’s car can be damaged.

Children’s liability and incapacity to tort

Children who have not yet reached the age of seven are considered incapable of tort in Germany. That means they are not responsible and are not liable for any damage they cause. The limit of liability for children for damage that occurs in road traffic is ten years. Parents – or their private liability insurance – only have to pay for damage caused by children who are incapable of tort if they have violated their duty to supervise.

Insurance coverage for children in private liability

Liability insurance is available for singles, single parents, couples without children and for the whole family. The following people are covered for tariffs that also insure children:

  • biological children as well as step-children, adoptive children, grandchildren and foster children
  • children of legal age during the federal voluntary service or a social or ecological year, provided they are not married and do not live in a registered civil partnership
  • Children who complete vocational or academic initial training following social service or immediately after school
  • Children who have become unemployed after an apprenticeship or training measure are usually insured with their parents for one year
  • Minors who are not related to the policyholder but live temporarily (usually up to twelve months) in their household (e.g. au pair, exchange student)
  • adults, unmarried and physically and / or mentally handicapped children not living in a registered civil partnership who live in a care facility; protection usually applies for an unlimited period
  • underage children of co-insured children

Second degree, second apprenticeship, internship, further training, part-time studies: If a child is in one of these training relationships, the insurance cover usually does not apply. If your children are completing a second degree, they should take out their own student liability insurance.
