Depending on which maintenance you want to calculate, you must first enter your monthly net income in the calculator. 5% for work-related expenses are automatically deducted from this net income in the calculator tool (at least 50 euros, maximum 150 euros). If you have higher work-related expenses, you can also note this, which is then calculated from the reduced amount. The computer data is up to date and has the values ​​from the Düsseldorf table 01/01/2019 as well as based on the minimum maintenance rates for 01/01/2020 already incorporated. Become regular amendments entered in the computer. The last change in the area of ​​the table amounts was on 01.01.2019. At the end of September 2019, the increase in the minimum maintenance for 2020 was announced – i.e. child support for minors. At the same time, the child benefit was increased by 10 euros per child from 01.07.2019. The next child benefit increase is not planned until January 1, 2021.

Half of the child benefit is deducted from these amounts, and the full amount is deducted from adults. The child benefit credit works automatically in the maintenance computer and does not have to be made up for separately.

Further maintenance calculations

The calculator not only calculates the child support to be paid, but also additionally

which is why the income of the maintenance creditor is also queried. This is based on the application of the 3/7 method of differential income between maintenance debtors and maintenance recipients.

In addition, the net income of the maintenance recipient is also required when calculating child support for children of legal age, since both parents are obliged to pay cash support when they reach the age of majority and have to share the calculated cash support in relation to their income.

Complex calculation processes

There are several things to consider when calculating maintenance. Firstly, the ranking – minors and privileged adults must always be served first, before spouses / parents and non-privileged adults.

In addition, the various deductibles must be taken into account, which are also based on the hierarchy of the dependent. These values ​​form the limit of the performance of the maintenance person and are intended to ensure the subsistence level. These values ​​are automatically saved in the Maintenance Calculator considered.

Depending on the amount of income and the number of children, it may well happen that after the maintenance obligation has been fulfilled, no further maintenance can be paid for the children, otherwise the deductible of the maintenance debtor would be lower. Not all dependents can lack income with the full maintenance, there is a quota distribution (deficiency case calculation).

Example for calculating maintenance in the event of a defect

A father has a monthly net income of € 1,400 and has to pay maintenance for two children. After deducting half of the child benefit, the following maintenance amounts would result from 01/01/2020:

  1. Child (16 years): € 395
  2. Child (11 years): € 322

In total, the father would have to pay € 717 child support. If you deduct this € 717 from the € 1,400 income, your deductible would be less than € 1,160 (from 2020). For this reason, the distribution mass of income must be used, which in this case is € 240 (€ 1,400 – € 1,160). This distribution mass is now related to the full child support, i.e. € 240 / € 717 = 0.33. This 0.33 is now the rate at which maintenance is paid 1st child € 395 * 0.33 = € 130.35 and 2nd child € 322 * 0.33 = € 106.26.

When maintaining a minor child, it should be noted that there is a legal minimum maintenance. The maintenance advance is paid in the same amount if the maintenance debtor does not meet his maintenance obligation.
