Annoyed thermomix buyers: vorwerk chopped guarantee – cleankids magazine

Second owners of a Thermomix TM5 run the risk of trouble if the food processor has a defect

A food processor “inspires all of Germany”, cheers manufacturer Vorwerk and celebrates the Thermomix TM5 with its twelve functions as “enormously powerful and innovative”. If you order the “all-rounder” sold through party sales, you have to wait weeks for delivery.

So it may be lucky to find out who can buy one of the marvels used, who even gives the 1199 euro kitchen machine for free gets and so you can immerse yourself in “the future of cooking” without waiting.

But be careful. Second owners of a Thermomix TM5 face trouble with the two-year legal guarantee. Because if the mixer doesn’t mix with them, the scales don’t weighs, the engine does not make noise, direct distributors Vorwerk refuses repair or replacement – and thus a legal obligation that only first-time buyers can easily request from the Wuppertal company.

Naughty too: Vorwerk is unsuspecting when asked by the NRW consumer center. The transfer of the guarantee to third parties is not "contractually" excluded. That may be true.

This does not help those affected, however, if the in-house customer service and the hotline, in writing and verbally, rigorously iron out the requests for help: "It is not possible to transfer the warranty of your Thermomix TM5 to third parties."

Because with direct sales Vorwerk there is a "personal guarantee". The result of the purchase contract and the signature of the customer – and be not on Third party transferable. Only “in exceptional cases”, for example if it is “a gift for a family member” and “the context is plausible”, will the recipient receive their rights.

Just curious: This crude rule is quickly chopped and chopped, mixed and kneaded by Vorwerk – if it serves to increase sales. When in the course of the model change from Thermomix TM31 to current TM5 customers sold their old kitchen wonders in abundance in order to acquire the more expensive successor version, there was "a one-off special arrangement" for second owners. They got their guarantee without grumbling.

It is understandable that an employee on the Vorwerk hotline moans with such crazy rules: "I don’t understand that, too, if I’m honest."

By contrast, the legal opinion of the Consumer Advice Center NRW is clear and understandable. It simply considers it inadmissible if Vorwerk claims that warranty claims cannot be assigned here. The consumer advice center advises those affected that they should not be washed away and should insist on their warranty rights.
