General Terms and Conditions of Travel4dogs

travel4dogs can act as an organizer (section A) and / or as an intermediary (section B).

Bookings of short breaks paid directly to the hotel, accommodation in the holiday home database, the hotel database and cabins in the cabin catalog are not covered by the EU package travel right.

Section A: General Travel and Terms and Conditions (GTC) of travel4dogs as tour operator

The following provisions apply to the contractual relationship between you (travel customer) and travel4dogs (tour operator), described below, for the conclusion of a package travel contract.

For all bookings applies:
The basis for a travel offer is the online travel advertisement on the website of travel4dogs (www.travel4dogs.de). Information in brochures, flyers, brochures, advertisements in magazines, on the Internet, etc. Advertising remarks do not constitute a binding travel offer by travel4dogs.

Bookings can be made electronically (online booking via the booking form, by e-mail) or by phone. A booking by mail or fax is not possible with travel4dogs.

1st booking
For bookings on the Internet, the following applies: By clicking the “Book now” button, travel4dogs offers to conclude the travel contract bindingly. Book your trip by phone or informally by email, to avoid misunderstandings, you will receive a summary of your booking request by e-mail from travel4dogs. With the confirmation on your part you offer travel4dogs the conclusion of a travel contract binding.

The transmission of the booking (electronically or by telephone) does not constitute a claim to the conclusion of a travel contract. Travel4dogs is rather free in the decision to accept the contract offer or not.

If your booking includes other passengers, you act as a booker (“main accountant”) as their representative. They are considered to be principals and assume the obligations of placing orders with travel4dogs (payments, withdrawal from the contract, etc.) in the absence of any other explanation. The communication and payments are made exclusively with / by the main booker. Travelers are not contractual partners for travel4dogs.

The receipt of your booking with us will be confirmed to you on working days within 24 hours by electronic means (E-Mail). When booking outside office hours, on weekends and public holidays, you will receive confirmation of receipt of your booking the next working day.

An acknowledgment of receipt does not constitute acceptance of the offer but merely a confirmation of receipt of the booking.

You are bound to your contractual offer for a maximum of 10 working days. Within this time, travel4dogs will check and book all desired services for your trip.

2. Conclusion travel contract
The travel contract is concluded when you receive a travel confirmation from travel4dogs.

The terms of contract underlying the travel contract will be made available to you. In retrospect, you can not invoke ignorance.

Travel may only be commenced with the number of registered persons and dogs registered on the travel confirmation. If you travel with more people and / or dogs, the on-site accommodation may refuse you. From this no claims can be made to travel4dogs.

3. Right of withdrawal
For contracts for travel services according to § 651 a ff. BGB, which are closed at a distance, the right of withdrawal does not apply. However, you can cancel your trip at any time prior to departure. In case of resignation travel4dogs is however entitled to demand compensation (cancellation costs).

3. Services and prices
Travel prices are per person and for the total travel duration according to the description.

travel4dogs does not charge any (hidden) booking fees or other service charges.

The services included in the travel price are described on the respective trip. We reserve the right to correct errors, misprints and arithmetical errors.

Tourist tax (tourist tax) is not included in the tour price (unless explicitly stated in the travel services). This tourist tax is to be paid by you locally in the respective hotels.

Special requests, conditional bookings or verbal side agreements are only valid if they are reported in writing by travel4dogs on the travel confirmation. Unlisted services were not booked.

4. Payment
Travel4dogs has taken out a bankruptcy insurance with HDI Global SE Hannover, Germany, to hedge its client funds. You will receive a security certificate together with the travel confirmation.

4.1. pay
Upon receipt of the travel confirmation / invoice and the security note a down payment of a minimum of 20% is required, the balance up to 4 weeks before departure. The arrival and remaining payments are to be made in one sum. If you transfer the payments in installments and various installments, we are entitled to charge a fee of € 15.

For bookings of 4 weeks or more before the desired start of the journey, the total amount is due immediately. The exact payment dates you will always find on your travel calculation.

The arrival and final payment must be made in one sum. For single payments by fellow travelers, installments or partial payments, we are entitled to charge an expense fee of € 15.

4.2. Late payments
If you do not make the down payment and / or the final payment in accordance with the agreed payment due dates, you are not entitled to claim for the travel services or to hand over the travel documents.

In case of late or missing payments, we are entitled, after a one-off reminder with deadline, to withdraw from the travel contract and to charge you with cancellation fees in accordance with the applicable cancellation policy.
In case of late payment additional costs will be charged for required express deliveries of travel documents.

You are not entitled to set off against claims for payment of the agreed travel price with counterclaims, unless the counterclaim is undisputed or legally established.

5. Cancellation, cancellation, rebooking, changes
At the conclusion of the travel contract, you have the cancellation and changeover deadlines and fees for your trip. These come into force when you cancel your travel or individual travel services or change services (transfer).

5.1. Cancellation (cancellation)
Cancellation occurs if you cancel your trip before departure or if you completely cancel some of the services (partial cancellation for less participants, rooms etc.).

You can cancel your trip at any time prior to departure. In the case of resignation travel4dogs loses the claim to the travel price, but then has the statutory right to a reasonable compensation (cancellation costs.).

Decisive for the cancellation is the receipt of the cancellation at travel4dogs:

Cancellation or rebooking can be done by phone or e-mail, Monday to Friday between 8:30 and 17:30. If you send us your cancellation / change request on workdays after 5.30 pm, on Saturday / Sunday or on a public holiday, the next working day will be considered the time of cancellation / rebooking. If you cancel in writing by post, the time of receipt of the letter is with us.

The amount depends on the travel price. As a rule, the cancellation fees that travel4dogs may demand in the case of withdrawal from the journey per registered participant:

Up to 31 days before departure: 20% of the travel price (minimum € 50 per participant)
28-21 days before departure: 40% of the travel price
20-15 days before departure 60% of the tour price
14-8 days before departure: 70% of the tour price
7-2 days before departure: 90% of the travel price
from 1 day before departure and non-arrival: 100%

The cancellation fees may vary depending on the booked trip. Binding are the cancellation costs, which you receive together with the travel confirmation.

You are at liberty to provide proof that no or less costs have been incurred in connection with the resignation or non-commencement of travel than the costs stated by us in the lump sum.

We can assert higher, concrete damage as agreed in the lump sum cancellation costs, if we prove that we have incurred considerably higher expenses than the respective applicable lump sum. In this case, we are obliged to specify and substantiate the required compensation, taking into account the saved expenses and any other use of the travel services.

If you have already received travel documents, these are to be returned to us at a travel cancellation to: travel4dogs, PO Box 114, 47628 Straelen.

5.2. Up- and second postings, change requests
For subsequently reported change requests such as additional nights, number of dogs, meal requests (vegetarian) and the like. we charge a processing fee of € 50 per transaction. There is no claim to fulfillment, since subsequent reported (change) wishes are dependent on the possibilities and / or capacities.

A change to another travel date is only possible from the time of booking confirmation in the form of a cancellation and a new booking, taking into account the valid cancellation costs for the journey.

According to § 651 e BGB (from 01.07.2018: § 651 e BGB) you can also specify a replacement person who will travel for you. If the replacement traveler meets the travel requirements or does not oppose his participation in any other statutory or regulatory orders, this will be treated as a rebooking.

6. Lack of physical or mental fitness
travel4dogs states in its itineraries, which you must take note of prior to booking, for all trips that include hikes and / or activities, a level of difficulty, and the length of walking stages, depending on the length of the trail, the difficulty of the terrain, the total duration of the journey and similar criteria. You, all traveling humans and dogs must have a sufficient physical condition, sufficient experience and a travel adequate equipment. If you or a traveling companion find out that humans and / or dogs are not up to the requirements of the journey, and for this reason cancel the trip or do not use individual travel services, there is no claim for reimbursement of the travel price, also not proportionally , We are not liable for any additional costs incurred by you or a fellow traveler (such as accommodation, veterinary or travel expenses).

7. Termination and exclusion for behavioral, psychological or physical reasons
travel4dogs can terminate the travel contract without notice if, despite a warning from us or a local assistant, you disrupt the itinerary on a sustained basis or if you behave in breach of contract to such an extent that immediate termination of the contract is justified.

In case of termination or exclusion we reserve the right to the travel price. However, we must recognize the value of the expenses saved and any benefits that we derive from any other use of the unused service, including any sums credited to the service providers.

8. Unused travel services (trip interruption)
If you do not use individual travel services such as overnight stays, meals, transfers, etc. (for example, in the case of early departure, for reasons for which you are responsible), you are not entitled to a (pro rata) refund of the travel price.

9. Liability
9.1. Liability of travel4dogs
The contractual liability of travel4dogs for damages that do not result from injury to life, body or health, and that were not culpably caused, is limited to three times the travel price.

In our itineraries, which you must take note of prior to booking, we indicate a degree of difficulty and the length of the walking stages for all trips that include hikes and / or activities, depending on the length of the trail, the difficulty of the terrain, the total duration of the journey and similar criteria. We assume no liability, whether you and / or your dog are able to cope with the requirements of the journey due to your physical condition, sufficient experience and / or equipment suitable for travel.

We are not liable for any information or performance disturbances in connection with services that are not contractually agreed main services and / or not part of the package and recognizable for the customer and referred to in the travel announcement or the booking confirmation and stating the identity and address of the brokered contractor as a third party are, or are only mediated during the stay as external services (eg wellness services, excursions, bike rental, etc.).

9.2. Your own liability
During the entire journey, you are solely responsible for the supervision of your dog.

You are liable for damages to third parties caused by your dog. We are not liable for damages caused by third parties and / or their dogs. For damage or additional cleaning costs (for example, if your dog sleeps in the hotel bed) at the property, the hotel operator may claim damages that must be paid by you.

In hiking trips, the use of the advertised trails at your own risk. Participation in (guided) travel and walks is at your own risk and responsibility for the participant and dog. Whether you and your dog are fit enough for a (multi-day) (hiking) trip only you or your veterinarian can judge (see point 9.1).

10. Your duties
10.1. Ticketing
With a successful booking you will receive a travel confirmation / invoice from us. You are obliged to check this confirmation for accuracy and to inform us immediately about any inaccuracies or deviations. Notices must be made within 3 days of receipt of the travel bill. Delayed displayed inaccuracies may not be considered or may no longer be considered free of charge and do not entitle you to withdraw from the contract. In this case, rebooking or cancellation fees may apply. A liability for damages on the part of travel4dogs of any damage resulting from this is limited or completely excluded in case of late notification of defects.

10.2. Report of travel deficiencies
Deficiencies in your trip, please report directly to your accommodation, hotel or your tour guide, so that directly remedied or a solution can be offered. Performance assistants on site (hotels, coaches, etc.) are not authorized to recognize claims.

If the travel deficiency in your opinion is not resolved, please contact us immediately – so already during your trip – to us. If you refrain from a direct notification of a travel shortage, there is no entitlement to a reduction in the travel price afterwards.

If the notification to us is culpable, any claims on your part shall be excluded from the contract, as far as a reasonable remedy by the tour operator or travel4dogs would have been possible.

If the trip is significantly impaired due to a lack of travel or you are the implementation of the trip as a result of such a lack of important, travel4dogs recognizable reason unreasonable, you can cancel the travel contract according to the statutory provisions (§ 651l BGB).

If you want to terminate the travel contract because of a travel shortage, you must first set us a reasonable deadline for remedial action. This only applies if the remedy is denied by the tour operator or if the immediate remedy is necessary.

As a traveler you have claims under § 651i Abs. (3) No. 2, 4-7 BGB for non-contractual provision of travel services to travel4dogs assert. A claim in writing (e-mail) is strongly recommended.

11. Travel documents
travel4dogs will provide travel documents or travel information to the main booker of the trip 14 days prior to departure, unless otherwise stated in the travel confirmation. This can be done by mail or e-mail.
Prerequisite for the preparation and dispatch of travel documents is the payment of the full travel amount.

You are obliged to check travel documents for accuracy and completeness without delay.
Recognizable errors, deviations, missing documents or other discrepancies must be reported to travel4dogs immediately. If you miss this message, a liability for damages on our part may be limited or completely excluded.

For shipments lost or delayed by the post office or other courier services we assume no liability. You are obliged to inform us immediately if you do not receive your travel documents on the agreed date (14 days before departure). If you fail to do so or report this to us too late, a replacement document can be deposited on site for a fee of € 25 per package. Tickets included in your travel documents, tickets or similar. are excluded from this and will be charged extra if they can be re-created at such short notice.

12. Changes to contract contents prior to departure that do not affect the travel price
Deviations of essential features of travel services from the agreed content of the travel contract, which become necessary after the conclusion of the contract and were not brought about by us in good faith, are permitted before the start of the journey, insofar as the deviations are insignificant and do not affect the overall layout of the travel (eg. Changes to your accommodation list).
In any case, we will inform you immediately after becoming aware of the reason for the change.
In the event of a subsequent, significant change in one or more travel services, you are entitled to either accept the change or withdraw from the travel contract free of charge within a reasonable time limit set by us simultaneously with notification of the change. If you do not explicitly declare your withdrawal from the travel contract within the deadline set by us, the change will be deemed accepted.

13. Exclusion of claims and statute of limitations
Claims according to § 651i BGB you have to assert against us. We recommend to do this in writing (e-mail). Claims for travel defaults become time-barred after two years. The statute of limitations begins with the day following the date of the contractual travel end.

If you and travel4dogs are negotiating the claim or the circumstances justifying the claim, the statute of limitation is suspended until you, as a travel customer or we as a tour operator, refuse to continue the negotiations. The statute of limitations occurs at the earliest 3 months after the end of the inhibition.

14. Insurance
Travel insurance is not included in our travel prices. It is recommended to take out travel cancellation insurance and insurance to cover the costs of repatriation in case of accident or illness.
The examination of the necessity of the conclusion and the suitability of one of the mentioned or further insurances is exclusively up to you as a travel customer.

Travelers must also have valid animal liability insurance. On request, you can provide the liability insurance on site.

15. Privacy
The surveys and processing of all personal data are carried out according to the German legal data protection regulations. Only such personal data will be collected and forwarded to partners,
which are necessary for the handling of your journey. Partners process and treat your data according to the legal data protection regulations.
You may object to the further use of your personal data for our own advertising purposes at any time by sending a message (e-mail). Your data will not be disclosed to unauthorized third parties under any circumstances.

16. Reference to special provisions
We teach you – when traveling outside Germany – in the course of your travel booking on general entry requirements and health regulations at the time of the conclusion of the contract. In the general information about such provisions by us, we go from the state at this time for German citizens. For other citizenship or other peculiarities we ask for communication.

It is expressly pointed out that there is always the possibility of a subsequent change of the legal travel regulations. We therefore strongly recommend that you follow the news media yourself in order to be able to prepare for any changes at an early stage.

You are responsible for complying with all regulations that are important for the journey (vaccinations, additional treatments for your dog etc.). All disadvantages, in particular the payment of cancellation fees, which arise from the non-compliance with these regulations, are at your expense.
This does not apply if non-compliance with these regulations is caused by a culpable misinformation or non-information on our part.

Liability of travel4dogs is excluded, except for intent and gross negligence.

17. Additional information
Our trips are generally unsuitable for people and dogs with limited mobility. Please contact us regarding your individual needs.

18. Dispute resolution
travel4dogs does not participate in a dispute resolution procedure before a consumer arbitration board and is not obliged to do so.

19. Modification of the General Terms and Conditions
We reserve the right to change our terms and conditions at any time without any obligation to notify you. The website always shows the current version of the general terms and conditions. By continuing to use the website after changing the terms and conditions, you agree to the changes.

20. Final provisions
The invalidity of individual provisions does not result in the invalidity of the entire terms and conditions or of the entire contract.

Dutch law shall apply to the relations of the parties, provided that this is not precluded by non-binding rules.

The following mediation conditions apply if a travel4dogs partner is the organizer of your booked travel. In this case we are not liable for the successful performance of the service itself, but only for the fact that the mediation is carried out with the necessary care. 8. Unused travel services (trip interruption)

9. Special provisions for group travel
9.1. Minimum number of participants
For group travel a minimum number of participants is necessary. These can be found in the travel description and on your travel confirmation. If the minimum number of participants is not reached, the tour can be canceled up to 14 days before the start of the event. All payments made so far will be refunded immediately without deduction. Further claims do not exist. External services, such as already purchased train tickets o.a. will not be refunded. We recommend organizing the arrival and departure only after the deadline has passed.

9.2. Running bitches / cancellation
Running bitches can not participate in the group walks in the common hikes. If your dog unexpectedly runs aground at the time of the trip and you cancel your trip for this reason, then the travel price will not be refunded. The cancellation fees apply. These cancellation costs are not compensated by a travel cancellation insurance. If you are unsure as to whether your dog might be in heat at the time of the journey, we advise against booking a group trip.

9.3. Vaccinations / liability insurance / Evidence
Participation in group travel is only possible if you have a valid animal liability insurance, also for the pet ownership risk, with sufficient coverage, and your dog, in addition to the mandatory vaccinations, has a basic immunization against rabies. Upon request, you can provide the liability insurance and the vaccination certificate to the tour guide.
Participants with list dogs are obliged to present the following proof upon booking and upon arrival to the tour guide: Leash and muzzle exemption, certificate of competence, permission for keeping. Without presentation of this evidence, participation in a group travel is not possible. The resulting cancellation costs are at the expense of the traveler.

10. Liability
10.1. Liability travel4dogs
Our contractual obligation is limited to the proper mediation of the offered and existing travel and services. In this case, we are liable as a travel agent for arranging, handling the booking, collecting and transmitting the travel documents, as far as we accept, with the due care of a proper businessman.

We are not liable for the successful execution of the travel or individual travel services, defects in the provision of services and personal and property damage, which may arise in connection with the mediated travel service.

Insofar as information about travel services is passed on to us by you, this does not entail any liability or assurance on the part of travel4dogs. In particular, we assume no liability or guarantee for the execution of travel or provision of services.

Our liability for culpable violation of intermediary obligations remains unaffected by the above provisions.

10.2. Your liability
During the entire journey, you are solely responsible for the supervision of your dog.

You are liable for any damages to third parties caused by your dog. Travel4dogs and / or the organizer is not liable for damage caused by third parties and / or their dogs. For damage or additional cleaning costs (for example, if your dog sleeps in the hotel bed) at the property, the hotel operator may claim damages that must be paid by you.

In hiking trips, the use of the advertised trails at your own risk. Participation in our trips and hikes is at your own risk and responsibility for the participant and dog.

In our itineraries, which you must take note of prior to booking, we indicate a degree of difficulty and the length of the walking stages for all trips that include hikes and / or activities, depending on the length of the trail, the difficulty of the terrain, the total duration of the journey and similar criteria. We assume no liability, whether you and / or your dog are able to cope with the requirements of the journey due to your physical condition, sufficient experience and / or equipment suitable for travel.

We are not liable for any information or performance disturbances in connection with services that are not contractually agreed main services and / or not part of the package and recognizable for the customer and referred to in the travel announcement or the booking confirmation and stating the identity and address of the brokered contractor as a third party are, or are only mediated during the stay as external services (eg wellness services, excursions, bike rental, etc.).

11. Your duties
11.1. Ticketing
With a successful booking you will receive a travel confirmation / invoice from us. You are obliged to check this confirmation for accuracy and to point out any inaccuracies or deviations. Notifications must be made within 3 days of receipt. Delayed displayed inaccuracies can no longer be considered and do not entitle the customer to withdraw from the contract. In this case, rebooking or cancellation fees may apply. A liability for damages on the part of travel4dogs of any damage resulting from this is limited or completely excluded in case of late notification of defects.

11.2. Report of travel deficiencies
Any deficiencies in our placement services must be reported to us without any delay. We must be given the opportunity to remedy the situation. If this notification culpably omitted, any claims of the traveler from the agency contract, as far as a reasonable remedy by us would have been possible. Claims based on tortious liability remain unaffected.

Defects during your trip, please report directly to your accommodation, hotel or your tour guide, so that can be remedied directly or a solution can be offered. If in your opinion the travel deficiency is not remedied, please contact the tour operator immediately (ie you will find a service telephone number in your documents) during your trip or to us.
If you refrain from a direct notification of a travel shortage, there is no entitlement to a reduction in the travel price afterwards.
If the notification to the organizer or travel4dogs is culpable, any claims on your part are excluded from the contract, as far as a reasonable remedy by the tour operator or travel4dogs would have been possible.

12. Travel documents
We provide the main booker of the trip with the travel documents or travel information – unless otherwise stated in the travel confirmation – 14 days before departure. This can be done by mail or e-mail.
Prerequisite for the preparation and dispatch of travel documents is the payment of the full travel amount.

You are obliged to check travel documents for accuracy and completeness without delay.
Recognizable errors, deviations, missing documents or other discrepancies must be reported to us immediately. If you fail to comply with this obligation, a liability for damages on the part of travel4dogs or the tour operator with regard to any resulting damage to the traveler in accordance with the statutory provisions on loss mitigation (§ 254 BGB) may be limited or completely excluded.

For shipments lost or delayed by the post office or other courier services we assume no liability. Shipment is at the risk of the traveler. You are obliged to inform us immediately if you have not received your travel documents by the agreed date (14 days before departure). If you do not comply with this obligation and the journey can not be started due to the missing travel documents, the tour operator can regard this as a withdrawal. As far as possible, substitute documents can be deposited on site for a fee of € 25 per package. Tickets included in your travel documents, tickets or similar. are excluded from this and will be charged extra if they can be re-created at such short notice.

13. Changes to contract contents prior to departure that do not affect the travel price
Deviations of essential features of travel services from the agreed content of the travel contract, which become necessary after the conclusion of the contract and were not brought about by us in good faith, are permitted before the start of the journey, insofar as the deviations are insignificant and do not affect the overall layout of the travel (eg. Changes to your accommodation list).
In any case, we will inform you immediately after becoming aware of the reason for the change.

14. Exclusion periods for defects and limitation
The provisions of §§ 651a ff. BGB, in particular § 651o BGB apply to the contractual relationship between you and the service provider. The same applies in the cases of § 651v Abs. 3 BGB for the relationship between you and travel4dogs as a travel agency.

The general legal provisions apply to the contractual relationship between you (travel agent) and us (travel agency) with regard to arranging travel services.

15. Insurance
Travel insurance is not included in our travel prices. It is recommended minimally the conclusion of a travel cancellation insurance and an insurance to cover the return costs in case of accident or illness.
The examination of the necessity of the conclusion and the suitability of one of the mentioned or further insurances is exclusively up to you as a travel customer.

Travelers must also have valid animal liability insurance. On request, you can provide the liability insurance on site.

16. Privacy
The surveys and processing of all personal data are carried out according to the German legal data protection regulations. Only such personal data will be collected and forwarded to partners,
which are necessary for the handling of your journey. Partners process and treat your data according to the legal data protection regulations.
You may object to the further use of your personal data for our own advertising purposes at any time by sending a message (e-mail). Your data will not be disclosed to unauthorized third parties under any circumstances.

17. Reference to special provisions
We teach you – when traveling outside Germany – in the course of your travel booking on general entry requirements and health regulations at the time of the conclusion of the contract. In the general information about such provisions by us, we go from the state at this time for German citizens. For other citizenship or other peculiarities we ask for communication.

It is expressly pointed out that there is always the possibility of a subsequent change of the legal travel regulations. We therefore strongly recommend that you follow the news media yourself in order to be able to prepare for any changes at an early stage.

You are responsible for complying with all regulations that are important for the journey (vaccinations, additional treatments for your dog etc.). All disadvantages, in particular the payment of cancellation fees, which arise from the non-compliance with these regulations, are at your expense.
This does not apply if non-compliance with these regulations is caused by a culpable misinformation or non-information on our part.

Liability of travel4dogs is excluded, except for intent and gross negligence.

18. Additional information
Our trips are generally unsuitable for people and dogs with limited mobility. Please contact us regarding your individual needs.

19. Dispute resolution
travel4dogs does not participate in a dispute resolution procedure before a consumer arbitration board and is not obliged to do so.

20. Change of the general terms and conditions
We reserve the right to change our terms and conditions at any time without any obligation to notify you. The website always shows the current version of the general terms and conditions. By continuing to use the website after changing the terms and conditions, you agree to the changes.

21. Final provisions
The invalidity of individual provisions does not result in the invalidity of the entire terms and conditions or of the entire contract.

Dutch law shall apply to the relations of the parties, provided that this is not precluded by non-binding rules.

Place of fulfillment and jurisdiction is the registered office of travel4dogs.
